Immediately following the premiere of “Sister Wives,” Utah authorities announced an investigation into Kody for potential bigamy, a felony with a maximum sentence of 20 years. Each of Kody’s wives also faced a potential 5-year sentence.

Believing his status as legally married to only one wife protected him, Kody did not anticipate the implications of Utah’s definition of marriage, often equating it to cohabitation. As he had lived with all four wives as a singular “family unit” for 16 years, many argued he was effectively in a common-law marriage with each wife.

Though the case was eventually brought to district court, it was ultimately dismissed. A ruling determined that equating marriage with cohabitation was unconstitutional. Subsequently, Utah escalated the matter to the US Court of Appeals for the Tenth Circuit, but it was dismissed there as well. The conclusion reached was that polygamy prosecutions should only proceed in instances involving child bigamy, fraud, or violence.

At one time, Kody was known for being in a polyamorous relationship with his “wives” Meri, Janelle, Christine, and Robyn, all of whom adopted his surname. Legally, he was only married to Robyn. Kody was earlier married to his first wife, Meri, but their divorce took place so he could legally adopt Robyn’s three kids from her previous marriage.
